Another case of zero to hero. Our client, a sweet and fragile older woman, was struck by a commercial 18-wheel truck and suffered serious injuries. When we notified the insurance company of our representation, they immediately dismissed her claim, insisting it had no value under Hawaiʻi law. They relied on a misinterpretation of an unusual provision in our “no fault” statute known as the “Covered Loss Deductible” (CLD). I initially tried to reason with the adjuster—hoping to resolve the matter amicably and achieve the best result for our client—but they refused to budge from their completely incorrect position that nothing was owed. The insurer even hired a Hawaiʻi attorney to defend the at-fault driver. Still, the litigation continued. But in the end, through persistence and careful legal work, we were able to present the case in its proper context under Hawaiʻi law and ultimately secured a substantial settlement. What started at zero ended at nearly one million dollars—proof that with experience, diligence, and patience, justice can prevail.
